1. Scope of application
The present general conditions of sale (hereafter ” CGV “) define the contractual relations between The Agency Consulting Sàrl and the purchaser and the conditions applicable to any purchase carried out by the means of the commercial site https://store.fight-district.com (hereafter ” online shop “), that the purchaser is professional or private individual. The Agency Consulting Sàrl reserves the right to modify its conditions of sale at any time. In this case, the conditions applicable shall be those in force on the date of the order by the buyer. The current version of the GTC is published on the website https://store.fight-district.com and is considered accepted by the customer as soon as it is published.
Provisions contrary to these general terms and conditions or general provisions of the customer or third parties shall not be valid. The GTC are also exclusively applicable if The Agency Consulting Sàrl provides its services without reservation, after having taken note of divergent provisions or general conditions.
2. Offer / Conclusion of the contract
The acquisition of a good through the merchant site implies unreserved acceptance by the buyer of these conditions. All information relating to the offer (hereinafter referred to as “the offer”) is without obligation for The Agency Consulting Sàrl and does not represent an application in the legal sense. The Agency Consulting Sàrl reserves the right to modify or cancel at any time the offers, i.e. the assortment and the prices. The images shown in product catalogues, brochures, advertisements, in the online shop, etc. serve exclusively as illustrations and are not binding for The Agency Consulting Sàrl.
By submitting the order for the goods during the ordering process in the online shop, the customer submits a binding offer that cannot be changed. After The Agency Consulting Sàrl has received the customer’s order via the online shop, an automatic order confirmation with an order number will be sent to the customer by e-mail. This order confirmation by e-mail does not represent an acceptance of the customer’s binding offer and no contract comes into effect. A contract does not come into force until the goods ordered have been sent by the customer. In case of non-availability of the ordered goods, The Agency Consulting Sàrl expressly reserves the right not to proceed with the delivery. In this case, the client will be informed immediately and payments already made will be refunded as soon as possible by The Agency Consulting Sàrl.
The prices in the catalogue are in Swiss Francs (CHF). The Agency Consulting Sàrl reserves the right to modify its prices at any time, however, the price that appears in the online catalogue at the time of the order is the only one applicable to the buyer.
The prices indicated do not take into account exchange rates and delivery costs, which are invoiced in addition and indicated before the order is confirmed.
For all orders of products requiring the minimum age of 18 years, the customer confirms by his order that he complies with the legal provisions.
3. Identity of the contractor
Unless otherwise expressly stated, the contract is concluded with The Agency Consulting Sàrl, based at Route de Lausanne 8, 1033 Cheseaux-Sur-Lausanne, through its official merchandising partner, the company Many-Ways SA, based at Avenue de Longemall 21B, 1020 Renens.

4. Delivery
The goods are delivered by a carrier commissioned by The Agency Consulting Sàrl to the address requested by the customer in the order form, at the time of the order.
Any shipping costs as well as additional cash on delivery costs in the case of cash on delivery orders will be communicated during the ordering process. Special shipping conditions apply to certain categories of goods and additional assembly and/or shipping charges may apply. The information in the online shop is binding and may be changed at any time with regard to costs, fees, assembly and/or shipping conditions.
The information on delivery times given in the online shop when ordering is not binding and can be changed by The Agency Consulting Ltd. at any time, even after receipt of the customer’s binding offer or after the automatic order confirmation has been sent by e-mail. In the case of orders placed with The Agency Consulting Sàrl on weekends, public holidays or weekdays after 5 p.m., delivery within the period indicated at the time of the order cannot be guaranteed.
In the event of damage during transport, a reasoned complaint must be made to the carrier within three days of delivery.
For international deliveries, the costs are at the buyer’s expense and vary according to the delivery zone. Delivery costs are calculated at the time of order completion and also depend on the amount of the order.
An additional customs clearance fee may apply if the buyer resides outside Switzerland.
5. Payment / Retention of title
The price is payable when the order is placed. Only the payment methods listed at the bottom of the shop.fight-district.com online shop are allowed. The invoice for the order constitutes proof of purchase.
If the customer chooses to pay by credit card / PayPal, the credit card / PayPal account will only be debited when the goods are sent and in case of a possible return (see chapter “Right of return or cancellation” below) after the receipt of the goods by The Agency Consulting Sàrl.
For cash on delivery payment, the customer will be charged an additional fee.
The delivered goods remain the property of The Agency Consulting Sàrl until full payment of the invoice amount by the client. The Agency Consulting Sàrl is entitled to enter the reservation of ownership in the reservation of ownership register.
6. Gift vouchers
The Agency Consulting Sàrl merchandising vouchers can only be used for the purchase of The Agency Consulting Sàrl merchandise, and under no circumstances for the purchase of other gift cards. The amount offered is indicated on each voucher, as well as the validity. Gift vouchers are non-refundable, non-exchangeable and non-renewable unless explicitly stated by The Agency Consulting Sàrl.
The use of gift vouchers varies: some vouchers are only valid for the online shop, some vouchers are valid in the official shop. The use is specified on each voucher.
Online use: when paying in the online shop, the promotional code shown on the voucher must be entered in the relevant field at the time of payment.
- Promotional codes are vouchers that cannot be purchased, but which we issue as part of promotional campaigns with a limited validity period.
- Promotional codes can only be used during the specified period, and only once per order. Certain brand products may be excluded from the promotion. Promotional codes cannot be used to purchase gift vouchers. Please note that promotional codes may be linked to a minimum order value.
- The value of the merchandise must correspond at least to the amount of the promotional code. If the value of the goods is higher, the difference can be made up with one of the payment methods offered. The amount of a promotional code is not paid out in cash and does not earn interest. The promotional code is not refunded if the goods are returned in whole or in part.
- Promotional codes can only be used before the order is placed. Subsequent allocation is not possible. The promotional code cannot be transferred to third parties. It is not possible to combine several promotional codes, unless we have agreed otherwise.
- If you have used a promotional code at the time of purchase, we reserve the right to charge you the original price of the merchandise you are keeping if – due to your cancellation – the total value of your order falls below the promotional code amount.
In-store use: when paying for goods in full or in part in a branch, the gift voucher (physical voucher) must be presented on the spot. The corresponding amount is deducted from the total value at checkout. In the event of a technical problem making payment by gift voucher impossible, The Agency Consulting Sàrl reserves the right to exceptionally refuse this type of payment.
The Agency Consulting Sàrl declines all responsibility in case of loss, theft or damage of a gift voucher. There will be no replacement for lost or damaged vouchers. Gift vouchers are not refillable and are not personalised.
7. Claim / Guarantee
After delivery by the carrier, the customer must immediately examine the goods for any defects. Complaints by the client must be made immediately, at the latest within 14 days of delivery of the goods to the client, to The Agency Consulting Sàrl, via the email address: infostore@fight-district.com. Defects that were not recognizable during the immediate examination by the customer (hidden defects), must be reported to the carrier and to The Agency Consulting Sàrl immediately after their discovery.
The customer’s warranty claims are limited to the replacement of the defective item or the rectification of the defect, to the exclusion of any other claims, including compensation for direct or indirect damage. The Agency Consulting Sàrl decides, at its discretion, on the replacement delivery or the removal of defects. The warranty claim expires in the event of damage resulting from improper handling and/or use of the goods.
8. RIGHT OF RETURN OR WITHDRAWAL
The customer may revoke his order for goods without justification by returning the goods ordered. The revocation by return must take place at the latest before the expiry of a period of 30 days from the delivery of the goods to the customer. Excluded from the right of return are goods that have to be assembled before delivery, swimwear, underwear, jewellery and swimwear with individual number printing as well as gift vouchers. The customer has two options for exercising the right of return or withdrawal:
8.1 Return to a branch/official shop
The Agency Consulting Sàrl only takes back intact, unused and complete goods in their original packaging with the corresponding return form.
In the official shop, the customer will be reimbursed the amount of the invoice for the corresponding goods by the payment method used by the customer at the time of purchase.
8.2 Return by Swiss Post
The customer can return the goods by post to the address below.

Please note that :
- The goods must be packed in their original packaging.
- The completed return form must be enclosed.
- Unstamped packages will not be accepted by The Agency Consulting Sàrl and will be returned to the sender at the latter’s expense.
- Timely submission is sufficient to meet the deadline.
- The customer must keep the customer coupon received upon delivery of the goods until the purchase price is refunded.
- The return is at the customer’s expense and risk.
- In case of complaints or discrepancies, the customer service of The Agency Consulting Sàrl is at your disposal by email: infostore@fight-district.com
- In case of return by post, the refund of the value of the goods is made within 30 days of receipt of the goods by The Agency Consulting Sàrl on the means of payment used at the time of purchase.
- Shipping and payment costs will not be refunded in the case of a return.
9. Bonus programme, competitions and events
The Agency Consulting Sàrl may offer the client to participate in bonus programs, contests and events. Participation in all bonus programmes, competitions and events is subject to the applicable conditions.
10. Data protection
The Agency Consulting Sàrl attaches great importance to the protection of the client’s personal data.
The Agency Consulting Sàrl undertakes to respect the confidentiality of the personal data communicated by the customers on the online shop and to treat them according to the Swiss legal obligations in force.
The Agency Consulting Sàrl only passes on personal data to third parties insofar as this is necessary for the proper execution of the order.
No data is passed on to third parties for commercial purposes.

11. Liability
The Agency Consulting Sàrl is not liable, to the extent permitted by law, for any direct or indirect damage resulting from the use of the online shop or in connection with orders for goods or the conclusion of contracts via the online shop. In particular, The Agency Consulting Sàrl declines all responsibility in case of slight or average negligence. Similarly, The Agency Consulting Sàrl assumes no contractual or non-contractual liability for damage caused by auxiliaries called upon to provide services.
12. Other provisions
12.1 Applicable law / Jurisdiction
All legal relations between the client and The Agency Consulting Sàrl are subject to Swiss law to the exclusion of the United Nations Convention on the International Sale of Goods.
All trademarks, photos and designs are registered and protected.
Any imitation or reproduction is liable to prosecution and a fine.
12.2 Salvage clause
Should individual provisions of the GTC be or become ineffective or should there be unforeseen gaps in the GTC, this shall not affect the validity of the remaining provisions or the GTC as a whole. The operative law replaces the invalid or missing provisions.
